Drug Offences: Possession, Trafficking, and Importing/Exporting

Drug Offences: Possession, Trafficking,

and Importing/

Exporting

Charges for the possession, production, and/or trafficking of drugs fall under the Controlled Drug and Substances Act (CSDA), which is federal legislation. Since drug offences are under federal jurisdiction, these matters are typically negotiated with Federal Crown Prosecutors, rather than Provincial Crown Prosecutors.

A drug offence conviction can have serious, long-term consequences on your life. A criminal record for drug charges can impact many aspects of a person’s life, including employment and international travel.

There are a number of drug offences, which cover a variety of criminal conduct. The type and quantity of the drug involved in the offence can significantly impact how the matter is treated before the courts. Some drug offences, such as trafficking offences, are typically treated very seriously and often carry higher sentences if you or someone you care about is convicted.

If you are charged with a drug offence, our experienced lawyers will review your case and determine whether there are any Charter challenges, which are common in drug cases. This includes challenging the grounds for your arrest, assessing whether you were subjected to unreasonable search and seizure, and challenging the validity of any search warrants the police may have obtained against you. We will ensure that your rights are protected and that every available defence is presented at trial.
